Terms of Service

1. General

These Terms of Service ("Terms") govern your use of the vaivatta. digital services ("Service"). The Service is provided by Innovategy Oy (Business ID: 3281265-2). By using the Service, you agree to these Terms.

2. Service Description

vaivatta. is a platform that allows users to deploy open-source business software. Basic software deployment is free. We offer optional paid add-ons including backup services, SLA agreements, and technical support.

3. User Accounts

Using the Service requires creating an account. You are responsible for:

• Accuracy of your account information
• Protecting your password and credentials
• All activity that occurs under your account

4. Acceptable Use

You agree not to use the Service for:

• Any illegal purposes
• Distributing malware or harmful software
• Interfering with the Service or other users
• Abusing Service resources or capacity

5. Pricing and Payment

Basic software deployment is free. Paid add-ons are billed according to the agreed billing cycle. Prices exclude VAT (25.5%).

Billing for paid add-ons begins from service activation. Cancellation is possible at any time. Payments already made are final and non-refundable.

6. Service Availability

We strive to provide the Service continuously. However, we do not guarantee uninterrupted service. Planned maintenance will be announced in advance. Service Level Agreements (SLA) are available as paid add-ons.

7. Data and Backups

You are responsible for backing up your own data unless you have subscribed to a backup add-on. We offer backup services as an add-on. Data stored in the Service is kept within the EU/EEA.

8. Intellectual Property

Software deployed through the Service are third-party open-source applications subject to their own licenses. The vaivatta. platform and its branding are the property of Innovategy Oy.

9. Limitation of Liability

The Service is provided "as is". We are not liable for indirect damages, loss of revenue, or data loss. Our liability is limited to payments made during the last 12 months.

10. Termination

You may stop using the Service at any time by deleting your account. We may suspend or terminate your access to the Service if you violate these Terms or misuse the Service.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service at least 30 days before the changes take effect.

12. Governing Law

These Terms are governed by Finnish law. Disputes shall be resolved in the District Court of Päijät-Häme, Finland.
